These are the terms and conditions applying to services provided to pupils of 1 Stop Instruction. Any reference to the masculine shall also apply to the feminine. Any pupil remitting monies for any a course of training provided by 1 Stop Instruction shall be deemed to have read, understood, and agreed these terms and conditions. Any minor that attends training should have these terms and conditions explained to him by a responsible adult and the pupil will be bound by these terms and conditions. These terms and conditions refer to all scooter and motorcycle tuition, including Compulsory Basic Training (CBT).
Scooter & Motorbike Tuition
1 - General
a- The pupil/instructor ratio, and the aptitude of the pupil, shall be determined by 1 Stop Instruction. If , in the opinion of 1 Stop Instruction, the pupil acts, during training, in any manner deemed to be dangerous to themselves or any individual or to any equipment provided by 1 Stop Instruction, then 1 Stop Instruction reserves the right to cancel any remaining training. 1 Stop Instruction reserves the right to retain any monies paid by the pupil.
b- Any agreed training must be completed, including practical test, within one months of any deposit being paid, unless otherwise agreed between the parties.
c- 1 Stop Instruction accepts no liability for any claim, loss, damage or expense arising out of the acts or omissions of it’s staff or agents, unless those acts or omissions are caused by the negligence or willful default of 1 Stop Instruction or its agents.
d- Any claim made by the pupil against 1 Stop Instruction or its agents shall at all time be limited to only the gross cost of training provided, excluding an amount for the test fee paid to the Driving Standards Agency (DSA) if applicable..
e- Force Majeure shall apply to this agreement.
f- 1 Stop Instruction will only provide a suitable Hi-Viz vest and, if required, a safety helmet and gloves to the pupil. Any protective clothing/waterproof clothing is highly recommended and should be provided by the pupil for his own safety and comfort.
g- The pupil will lose any deposit paid and will not be allowed to train if he:
i- fails to start the course at the time advised to him by 1 Stop Instruction.
ii- fails to bring both parts of his provisional/full license to the training course.
iii- fails to satisfy any eyesight requirements as stated by the DSA.
iv- fails to satisfy the instructor of any requirements in respect of the highway code and/or road traffic procedure as sated by the DSA.
2 - Payments:
a- CBT training. A payment in full must be paid for any CBT booking. Any cancellation or alteration of a booking must be made 72 hours before the booking date, at the latest, and will be subject to a cancellation fee of £20.00. This fee may be waived if the pupils rebooks another CBT place within 14 days of the cancelled date. This waiver can only be applied once and is at the sole discretion of 1 Stop Instruction Instruction.
b- Other courses. A non-refundable deposit of £200.00 must be paid by the pupil. Any cancellation of a booking will result in the pupil forfeiting their deposit. Any alteration to booked courses must be agreed with 1Stop Instruction, in writing or email, at least 21 days prior to the first day of the booked course. Failure to do so will result in any monies paid by the pupil being retained by 1 Stop Instruction.
c- 1 Stop Instruction will only take course deposits if the pupil has a valid theory certificate. However, if the pupil wishes to book a course without a valid theory certificate, they can choose to do this but must pay for the full price of the course in advanced and in cleared funds. Any payments made to 1 Stop Instruction by the pupil are non-refundable under any circumstance, including any cancellations or alterations of a course.
d- Any balance of fees must be paid in cleared funds no later than at least three days prior to the first day of such training or as otherwise agreed between the parties. No refunds shall be made to the pupil once training has commenced.
e- All payments made by the pupil for training must be in cleared funds before the first day of training. Any credit card payments made are subject to an additional charge of 5%. Any returned cheques are subject to an administration fee of £30.00 per returned occasion.
3 - Damage Deposits.
a- CBT Training. No deposit is required but the pupil agrees to be responsible for any loss or damage caused to any equipment, including any bike or scooter, provided by 1 Stop Instruction. To minimize any such cost 1 Stop Instruction reserve the right to cancel the pupils training at any time in accordance with paragraph 1a of these terms and Conditions. All payments in respect of damaged equipment must be paid by the pupil to 1 Stop Instruction within 14 days of the damage occurring.
b- Other courses. The pupil agrees to deposit an amount of £150.00 (for bikes up to £125cc), or £200.00 (for bikes over 500cc) with 1 Stop Instruction (Excess damage deposit). This deposit is refundable in full if the pupil does not drop the bike, on any single occasion, or damage any equipment lent to the pupil by 1 Stop Instruction No partial refunds of this deposit are payable by 1 Stop Instruction whatsoever.
d- Alternatively the pupil may pay to 1 Stop Instruction an amount of £50.00 (for bikes up to £125cc) or £90.00 (for bikes over 125cc) as an excess waiver premium. The pupil accepts that this is non refundable in any event.
e- In the event of additional training and/or bike use being required by the pupil, beyond that agreed with 1 Stop Instruction, this will be provided at a cost agreed by the parties.
4 - Pupils obligations:
a- The pupil must at all times be legally entitled to undertake the training and as such must always have available for inspection by 1 Stop Instruction either their provisional or full driving license (both parts), their current theory pass certificate and their current CBT certificate, if applicable. In any event, the pupil must bring these original documents for inspection on the first day of training. Failure to do so will result in the cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
b- The pupil must also be able to read a number plate at a distance of over 20.5 meters or at a distance determined by the DSA at the training date(s). Failure to do so will result in the cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
c- The pupil must be at the training venue advised by 1 Stop Instruction by the time agreed for the benefit of other pupils. Failure to do so will result in the cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
d- Unless otherwise agreed with 1 Stop Instruction, the pupil must bring suitable protective and waterproof clothing and a safety helmet in accordance with current UK legislation. 1 Stop Instruction reserves the right to determine what is deemed to be ‘suitable’ clothing. Short sleeve shirts, shorts, sandals, or other such clothing shall not be acceptable for training. The pupil’s non compliance will result in the cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
e- If the pupil is using their own bike for training, then the bike should be the right specification for the course being attended and in a roadworthy condition as determined by 1 Stop Instruction and shall meet all current UK legislation requirements at that time. The pupil shall bring and retain a current MOT certificate, if applicable, insurance certificate and road tax for the bike being used. The pupil’s non compliance will result in the cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
f- For reasons of safety, the pupil shall at all times wear a suitable hi viz vest provided by 1 Stop Instruction. The pupil shall also at all times adhere to instructions given by 1 Stop Instruction and act in a manner so as not to bring harm themselves or any other individual. This vest to be returned to 1 Stop Instruction at the end of each day’s training. Failure to do so will result in the immediate cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
1 Stop Instruction obligations:
a- To provide training to the pupil to a standard required to prepare the pupil for the purposes of compulsory basic training ( CBT) and/or the practical motorcycle test in accordance with the requirements of the Driving Standards Agency (DSA). This training is to be provided on a date(s) agreed with the pupil but 1 Stop Instruction reserves the right in the event of unforeseen circumstances, including mechanical breakdown, to alter this date(s) to an alternative date(s) and advise the pupil accordingly. The pupil agrees that this training may be on consecutive or non-consecutive dates.
b- If agreed with the pupil, 1 Stop Instruction agrees to provide a suitable bike, and/or protective equipment, for training purposes which meets current UK legislation. Any such items provided shall at all times remain the property of 1 Stop Instruction and must be returned by the pupil at the end of each days training..
c- Where a bike is provide by 1 Stop Instruction, to provide adequate fuel for training purposes.
d- To always have in place adequate insurance for the training bikes provided.
e- To always have in place suitable Professional Indemnity insurance.
f- 1 Stop Instruction will liaise with DSA to book, and pay for, the pupils first test date at a suitable DSA test centre, if applicable. Unless otherwise agreed, 1 Stop Instruction shall at all times only be liable for the first test date fee for the pupil.
Re-tests
CBT training. In the event of the pupil not fulfilling the required standards, as stated by the DSA, to achieve a CBT certificate, the pupil has to rebook a new CBT course at normal fee rate.
Other courses. In the event of re-sitting any other training course the fee payable to 1 Stop must be paid in advance in cleared funds, and is non-refundable under any Circumstances including any cancellations or alterations of a re-sit or re-sit course.
Complaints
Any complaints must be made in writing and be received by 1 Stop Instruction, at their offices, within seven days of such action which caused the complaint.Driving Instruction / Cars
Payments
1. All payments made by pupils should be in cash, cheque or credit card. All payments must be cleared before the first lesson. Any credit card payments made are subject to an additional charge of 5%. Any returned cheques are subject to an administration fee of £30.00 per return.
2. Individual or blocks of ten lessons are payable for in FULL, in cleared funds, on or before the first lesson. The ten lesson discount can only be applied once per pupil. Please refer to our latest fee scale.
3. Any payments made to 1stop Instruction are non refundable except at the absolute discretion of 1 Stop Instruction.
4. Receipt of your deposit/payment is your full acceptance of our terms and conditions.
Refunds
5. Lesson and Course fees are non-refundable. (Refunds will only be issued in exceptional circumstances i.e. if the instructor is unable to provide the service originally booked by the pupil). Deposits are non-refundable.
6. Lesson/course fees may at the discretion of the school be transferred to another 1stop Instruction instructor.
7. Your Progress/appointment card acts as your receipt and must be brought to every lesson.
8. All lessons must be completed within 3 months of booking (two months if less than ten hours).
Tests
9. Tests, although paid for by candidate, are not guaranteed at the end of hours booked, if the standard of driving, REQUIRED BY THE INSTRUCTOR, for the practical test has not been reached. Extra hours will need to be booked and paid for before candidate is taken for test which will be always at the instructors discretion.
10. Post test courses are to be taken in weekdays between the hours of 9am and 5pm unless special arrangements were made at time of booking. In exceptional circumstances lessons may be able to be arranged for evenings/weekends and these may be subject to additional charge, which will be confirmed by 1stop Instruction to the pupil. All post test courses not paid for in full by the due date will be considered as cancelled by applicant and any deposit paid will be forfeited.
11.The school/instructor cannot be held responsible for tests/lessons cancelled either by the DSA or for bad weather. In the event of mechanical failure, 1stop Instruction liability will be limited to offering replacement lessons for any lessons affected.
General
12. All instructors work under a franchise contract with 1stop Instruction Driving School. They are responsible to 1stop Instruction for your tuition, conduct and the condition of their car. 1stop Instruction act as agents for it’s franchised instructors and is not responsible for money paid to such instructor or booking dates and times.
13. Every endeavor will be made to make available the same instructor and car for driving lessons and driving test, but the school retains the right to change either if the situation so warrants. In certain circumstances the school/instructor has the right to terminate lessons or test should they feel it necessary.
14. All changes to courses once booked may incur an administration fee of £20.00 and will only be accepted at the discretion of 1stop Instruction. Changes to Test dates are dependant on availability of both test date and instructor, and in most cases must be received and acknowledged before the start date of the course. All changes must be requested in writing and signed by the person the course has been booked for. Courses and or deposits are not transferable.
Complaints
15. Complaints must be made in the first instance to the instructor concerned. If you are not able to resolve the matter with the instructor, you may telephone the office. As a final step, complaints can be put in writing to 1 Stop Instruction, 18 Regent Gardens, Ilfrod, Essex IG3 8UL. Complaints in writing will only be considered if they are received by the school within 21 days of the incident.
Cancellations
16. If you wish to cancel or re-arrange a lesson a minimum 48 hours prior notice must be given. Cancellations must be made directly between you and your instructor. If you do not give at least 48 hours notice of cancellation, your instructor will be entitled to charge you for the lesson(s) cancelled.
