These are the Terms & Conditions by and subject to which 1 Stop Instruction (which shall refer hereinafter to the businesses of 1 Stop Instruction, 1 Stop Instruction Limited and 1 Stop Instruction training Days Limited, its servants or agents or other representatives hereinafter and collectively referred to as “1 Stop Instruction”) agrees to provide tuition, and allow a motorcycle, scooter or driving pupil or the pupils agent or representative (hereinafter referred to as the ”Pupil”) to participate such training as requested by the pupil from 1 Stop Instruction and by and subject to which 1 Stop Instruction agrees to provide such training at the request of the pupil. Prior to participating in the training and/or making use of any other requested service, the pupil, by attending such training is entering into a legally binding agreement which is strictly subject to the Terms & Conditions set out herein. In this Agreement, for the purposes of convenience the masculine gender is used to refer also to the feminine and force majeure shall apply. Terms & Conditions are severable, the validity of a condition does not affect the validity of any other condition, and where a part of one condition is invalid then that part is severable from the rest of that condition. Any minor that attends training should have these terms & conditions explained to him by a responsible adult. Any individual who books and/or pays for any service, on behalf of other individual(s), to be provided by 1 Stop Instruction agrees to act as an Agent of that individual and be bound by these terms and conditions irrevocably. Any individual(s) not wanting to be bound by these terms & conditions should not proceed with any such training and not remit any fees to 1 Stop Instruction. Once any such fees are remitted, it is assumed that the pupil has read, understood, and agreed to be bound by these terms & conditions. Any complaint regarding any service provided by 1 Stop Instruction to the pupil shall only be responded to by 1 Stop Instruction if made in writing, or by email, and accepted and acknowledged by 1 Stop Instruction within seven days of such action that instigated the initial complaint. IMPORTANT: Please read carefully.
Scooter & Motorbike Tuition
1 - General
a- The pupil/instructor ratio, and the aptitude of the pupil, shall be determined by 1 Stop Instruction. If, in the opinion of 1 Stop Instruction, the pupil acts, during training, in any manner deemed to be dangerous to themselves or any individual or to any equipment provided by 1 Stop Instruction, then 1 Stop Instruction reserves the right to cancel any remaining training and further reserves the right to retain any monies paid by the pupil. Once the pupil has attended the first day of training, and paid the course fee in full, these monies shall be retained by 1 Stop Instruction in any event. In respect of any full motorcycle test training course on a manual machine, using gears and clutch, the pupil should be competent and able to be able to ride a manual machine without assistance to at least that standard required by Compulsory Basic Training (CBT) and this standard shall be determined by 1 Stop Instruction. When any pupil is unable to meet this requirement on the first day of any full motorcycle test training course, then 1 Stop Instruction shall reserve the right to cancel any further training and retain any monies paid by the pupil to 1 Stop Instruction.
b- Any agreed training must be completed, including practical tests, if applicable, on the dates agreed and stated in the confirmation sent to the pupil by 1 Stop Instruction, or as otherwise advised to the pupil by 1 Stop Instruction. In respect of full motorcycle training courses, Modules 1 & 2 must be completed within 4 months of the first Module 1test date. Failure to complete Modules 1 & 2 within this time will result in all further training to the pupil ceasing and 1 Stop Instruction retaining any monies paid by the pupil. In respect of CBT training, any fee paid by the pupil must be utilised within 30 days of the payment being made to 1 Stop Instruction. Failure to do so will result in no training being provided by 1 Stop Instruction, and the fee paid by the pupil being retained by 1 Stop Instruction. In respect of any pupil that elects to not proceed with any aspect of training, any fees paid to 1 Stop Instruction will be retained by 1 Stop Instruction.
c- In respect of any Gift vouchers purchased, these must be utilised by the expiry date provided on the certificate and only by the individual named on the certificate. Failure to do so will result in no training being provided by 1 Stop Instruction, and the fee paid, in respect of the certificate, being retained by 1 Stop Instruction.
d- 1 Stop Instruction accepts no liability for any claim, loss, damage or expense arising out of the acts or omissions of it’s staff or agents, unless those acts or omissions are caused by the negligence or willful default of 1 Stop Instruction or its agents.
e- Any claim made by the pupil against 1 Stop Instruction or its agents shall at all times be limited to only the gross cost of training provided, excluding an amount for any test fee paid to the Driving Standards Agency (DSA) if applicable.
f- Force Majeure shall apply to this agreement.
g- 1 Stop Instruction will only provide a suitable Hi-Viz vest and, if required, a safety helmet and gloves to the pupil. Any protective clothing/waterproof clothing is highly recommended and should be provided by the pupil for his own safety and comfort.
h- The pupil will forfeit any deposit or any other monies paid and will not be allowed to train if he:
i- fails to start the course, for any reason whatsoever, at the date and time advised to him by 1 Stop Instruction.
ii- fails to bring both parts of his provisional/full driving license and any other paperwork requested by 1 Stop Instruction to each day of his training course.
iii- fails to satisfy any eyesight requirements as stated by the DSA.
iv- fails to satisfy the instructor of any requirements in respect of the highway code, road traffic legislation and/or road traffic procedure as sated by the DSA.
i- In the event of the DSA canceling a test, for any reason whatsoever, the pupil is responsible for claiming any compensation payment, which may be due, from the DSA. 1 Stop Instruction shall remain entitled to retain any monies paid for tuition, DSA test fees, and/or bike hire in respect of any such cancelled test appointment. 1 Stop Instruction cannot be compelled to provide any training and/ or bike hire for any rescheduled test appointment made by the DSA or the pupil and, in the event of 1 Stop Instruction agreeing to provide such service, fees shall be payable by the pupil as agreed with 1 Stop Instruction.
j- By attending any training course, the pupil agrees to 1 Stop Instruction using any pictures or video feedback of the pupil for marketing purposes and consents to 1 Stop Instruction emailing the pupil with any information that may be, in the opinion of 1 Stop Instruction, of interest to the pupil. If the pupil does not consent to this he should email his written objection to info@1stopinstruction.com.
k- All training is subject to the pupil having read, understood and agreed to the conditions of a liability disclaimer which is available for reading on 1 Stop Instruction’s website. This liability disclaimer is also provided under section 8 of these terms and conditions. By attending any training course the pupil is deemed to have read, understood and agreed to such disclaimer.
l- All payments made by the pupil for training must be in cleared funds before the first day of training. Any credit card payments made are subject to an additional charge of
5%. Any returned cheques are subject to an administration fee of £30.00 per returned occasion.
m- All courses, excluding CBT, shall also incur a weekend supplement of £10.00 per weekend day plus a weekend test fee supplement of £20.00 per test appointment.
n- ‘working days’ shall only refer to weekdays, excluding public holidays.
o- It is the pupil’s responsibility to bring all the required paperwork to the DSA test centre for any practical test. Further information and clarification of such paperwork can be obtained by the pupil contacting the DSA. 1 Stop Instruction cannot be liable for any missing or forgotten paperwork.
p- ‘Required paperwork’ shall refer to only original, current and valid documents and shall include; Either an old style provisional or full driving license supported by a current (not expired) UK passport, or a new style full or provisional driving license (both parts). If the photocard of the new style license has expired then it must be supported by a current and valid UK passport. Dependent upon the course chosen, you may also have to provide a current CBT certificate and a current theory certificate.
2 - Payments
a- CBT training. A payment in full must be paid for any CBT booking. Any cancellations or alterations to a booking must be made 5 clear days before the date of the booked CBT course, at the latest, and will be subject to an administration fee of £30-00 for each place booked. The alteration of a CBT can only be applied once and is at the sole discretion of 1 Stop Instruction. Cancellations or alterations made within 5 clear days of the course date will result in any fees paid by the pupil being retained by 1 Stop Instruction.
b- Other courses. A deposit of £200-00 or a lower gross course cost amount must be paid by the pupil. Any cancellation or alteration to booked courses must be agreed with 1 Stop Instruction, in writing or email, at least 21 days prior to the first day of the booked course at the latest, and will be subject to an administration fee of £50-00. Any cancellation or alteration made within 21 days of the first day of the booked course will result in any monies paid by the pupil being retained by 1 Stop Instruction. Any amount paid in excess of the £200.00 deposit shall be refunded to the pupil in any event.
c- Any balance of fees must be paid in cleared funds no later than at least three days prior to the first day of such training or as otherwise agreed between the parties. No refunds shall be made to the pupil once training has commenced.
d- If the pupil requests, and remits payment for either as a free standing test or as part of a course, a Module 2 test within 3 working days of him having attended and failed the Module 1 test, then the pupil will forfeit any monies paid in respect of training or test fees for the Module 2 test and will not be allowed to attend the same.
e- Gift Certificates. Any gift certificate purchased by a pupil, or on behalf of a pupil by a third party, shall have a cash value of no more than £0.01p. Any amount mentioned on the gift certificate must be used for the individual named on the gift certificate only and 1 Stop Instruction reserve the right to ask for proof accordingly. Any gift certificate must be used, and the chosen course attended, and completed in full, by the pupil named in the gift certificate, within twelve months of the date of issue of the gift certificate. No refund, in part or full, is made by 1 Stop Instruction in respect of any individual who purchased the gift certificate or in respect of any pupil who attended any course identified for his benefit by the gift certificate, in any circumstance. Any course chosen by the pupil named in the gift certificate are subject to all the other terms and conditions of 1 Stop Instruction. In the case of the gift certificate being worth more in value than the course the pupil named in the gift certificate wishes to attend, then no partial refunds are offered in any event, and any other balance will be forfeited.
3 - Damage Deposits
a- CBT training. No deposit is required, but the pupil agrees to be responsible for any loss or damage caused to any equipment, including any bike or scooter, provided by 1 Stop Instruction, whilst in the pupil’s care and control. To minimise any such cost, 1 Stop Instruction reserve the right to cancel the pupils training at any time in accordance with paragraph 1a of these Terms and Conditions. All payments in respect of damaged equipment must be paid by the pupil to 1 Stop Instruction within 14 days of the damage occurring.
b- Other courses. The pupil agrees to deposit an amount of £250.00 with 1 Stop Instruction (damage deposit). This deposit is refundable in full if the pupil does not damage or drop the bike, on any single occasion, or collide with any object or individual, or damage any equipment lent to the pupil by 1 Stop Instruction. No partial refunds of this deposit are payable by 1 Stop Instruction whatsoever. This damage deposit only applies to those dates agreed and stated in the confirmation, or otherwise agreed between the parties, sent to the pupil by 1 Stop Instruction.
c- Alternatively, the pupil may pay to 1 Stop Instruction a non refundable insurance excess premium of £10.00 for each day of training, which is also applicable for any test re-sit days.
d- In the event of additional training and/or bike use being required by the pupil, beyond that agreed with 1 Stop Instruction, this will be provided at a cost agreed by the parties. A damage deposit or insurance excess premium will be payable by the pupil as stated in paragraphs 3b and 3c.
4 - Pupils obligations
a- The pupil must at all times be legally entitled to undertake the training and as such must always have available for inspection by 1 Stop Instruction their current and valid provisional or full driving license (both parts), their current theory pass certificate, if required, and their current CBT certificate, if applicable. In any event, the pupil must bring these original documents for inspection on each day of training. Failure to do so will result in the cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
b- The pupil must also be able to read a number plate at a distance of over 20.5 meters or at a distance determined by the DSA at the training date(s). Failure to do so will
result in the cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
c- The pupil must be at the training venue advised by 1 Stop Instruction by the time agreed for the benefit of other pupils. Failure to do so will result in the cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
d- Unless otherwise agreed with 1 Stop Instruction, the pupil must bring suitable protective and waterproof clothing and a safety helmet in accordance with current UK legislation. 1 Stop Instruction reserves the right to determine what is deemed to be ‘suitable’ clothing. Short sleeve shirts, shorts, sandals, or other such clothing shall not be acceptable for training. The pupil agrees not to hold 1 Stop Instruction liable for any injury sustained whether wearing suitable protective clothing or not. The pupil’s non compliance will result in the cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
e- In respect of any required training exercises carried out by the pupil, whether on a public road or the training site, the pupil accepts that these exercises are carried out at his own risk and volition. The pupil agrees not to hold 1 Stop Instruction and/or Powerleague liable for any injury sustained to himself, howsoever caused, whilst carrying out such exercises.
f- If the pupil is using his own bike for training, they should ensure that it is the right specification for the course being attended, including the display of two legal sized ‘L’
plates, and in a roadworthy condition as determined by 1 Stop Instruction and shall meet all current UK legislation requirements at that time. The pupil shall bring and retain
a current MOT certificate, if applicable, insurance certificate, current valid original CBT certificate and road tax for the bike being used. The pupil’s non compliance will result in the cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
g- For reasons of safety, the pupil shall at all times wear a suitable hi viz vest provided by 1 Stop Instruction. The pupil shall also at all times adhere to instructions given by 1 Stop Instruction and act in a manner so as not to bring harm to themselves or any other individual. This vest, and any other equipment belonging to 1 Stop Instruction, is to returned to 1 Stop Instruction at the end of each day’s training. Failure to do so will result in the immediate cancellation of training and the pupil forfeiting any monies paid to 1 Stop Instruction.
h- In respect of any full motorcycle test course, including A2 Restricted Access and Direct Access courses, the pupil shall comply with the DSA’s requirements in respect of the wearing of ‘suitable protective clothing’ introduced on the 1st July 2011. Further information can be found on the DSA website or via this link: http://www.dft.gov.uk/news/news-items/dsa-news-20110616 1 Stop Instruction cannot be liable for any test which is cancelled due to the non wearing of such suitable clothing by the pupil and any test which is cancelled under these circumstances shall be treated as if the pupil had failed the test by 1 Stop Instruction, and the pupil will have to resit the test as stated in Paragraph 6 of these terms and conditions.
5 - 1 Stop Instructions obligations
a- To provide training to the pupil to a standard required to prepare the pupil for the purposes of compulsory basic training (CBT) and/or the practical motorcycle test, or Enhanced Rider Scheme, in accordance with the requirements of the Driving Standards Agency (DSA). This training is to be provided on a date(s) agreed with the pupil but 1 Stop Instruction reserves the right in the event of unforeseen circumstances, including, but not limited to, mechanical breakdown, to alter this date(s) to an alternative date(s) and advise the pupil accordingly. The pupil agrees that this training may be on consecutive or non-consecutive dates.
b- If agreed with the pupil, 1 Stop Instruction agrees to provide a suitable bike, helmet and gloves, for training purposes which meets current UK legislation. Any such items provided shall at all times remain the property of 1 Stop Instruction and must be returned by the pupil at the end of each days training.
c- Where a bike is provided by 1 Stop Instruction, to provide adequate fuel for training purposes.
d- To always have in place adequate insurance for the training bikes provided.
e- To always have in place suitable Professional Indemnity insurance.
f- 1 Stop Instruction will liaise with the DSA to book, and pay for, the pupils first test date at a suitable DSA test centre, if applicable. Unless otherwise agreed, 1 Stop Instruction shall at all times only be liable for the first test date fee for the pupil.
g- In the event of mechanical failure, 1Stop Instruction’s liability will be limited to offering replacement lessons for any lessons affected.
6 - Re-tests
a- CBT training. In the event of the pupil not fulfilling the required standards, as stated by the DSA and/or these terms & conditions, to achieve a CBT certificate, the pupil can rebook a new CBT course at normal fee rate, applicable to the current normal fee at the date of such new CBT course. However, if the pupil has not attained the required standard during Element 'E' of the CBT course, and with the confirmation of the 1 Stop Instruction Instructor providing such instruction to the pupil at that time, the pupil may elect to attend another Element 'E' session only, at a fee determined by 1 Stop Instruction at the time of such election by the pupil. This session will be subject to at least two pupuils attending such session and shall be made avail;able at the discretion of 1 Stop Instruction. The pupil must note however, that by him attending such session, he is still obliged to meet the requirements of 1 Stop Instruction and the DSA in order to be successful, and 1 STop Instruction cannot guarantee such success in any event.
b- Other courses. In the event of re-sitting any practical test, due to a test failure being recorded against the pupil, or due to the pupil being in breach of any of these terms and conditions, the test resit fee payable to 1 Stop Instruction, which can be found on our website, must be paid in advance in cleared funds. 1 Stop Instruction do not guarantee to provide any additional training for such practical test resit but may provide such training at their sole discretion.
c- In the event of re-sitting any practical test, due to an ‘abandoned’ test being recorded against the pupil, or due to the DSA cancelling the test due to adverse weather or lack of examiners, or any other reason, the test resit fee will be determined by 1 Stop Instruction on an individual basis. In any event, this fee shall not exceed the fee charged for the pupil having to resit a Module 2 practical test.1 Stop Instruction do not guarantee to provide any additional training for such practical test resit but may provide such training at their sole discretion.
d- 1 Stop Instruction may, at their sole discretion, assist in any compensation claim made to the DSA, by the pupil, but any fees paid to 1 Stop Instruction in respect of such test will be retained by 1 Stop Instruction in any event.
7 - Practical Tests
The pupil accepts that if he has booked and paid for the Module 2 test to take place within three days of his Module 1 test, and he subsequently fails his Module 1 test,
he will:
a- Not be eligible to attend the Module 2 test.
b- Not be eligible for any further training prior to the scheduled Module 2 test.
c- Will not receive any refund of any fees in respect of the scheduled Module 2 training or test.
8 – Liability Disclaimer
RIDING A SCOOTER/ MOTORBIKE CAN BE VERY DANGEROUS! By attending training with 1 Stop Instruction (which shall mean 1 Stop Instruction and 1 Stop Instruction Limited and 1 Stop Instruction Training Days Limited)each pupil agrees to:
Understand and accept that in order for the pupil to attain a Compulsory Basic training Certificate (CBT), and/or prepare for the practical motorcycle test, 1 Stop Instruction are willing to provide training to the pupil, including any required maneuvers at 1 Stop Instruction’s training site, based in the Powerleague car park, Forest Road, Ilford, Essex, IG6 3HJ, as well as on any public roads, in any prevailing weather conditions deemed acceptable by 1 Stop Instruction.
In the case of CBT training, the pupil should be satisfied with the training they have received so far and feel sufficiently competent to proceed with the fifth element
involving a minimum of 2 hours riding on the public highway. In all other cases the pupil should be satisfied with any training provided, or their own riding experience, to
proceed with further training including riding on a public highway and/or preparing for any requirements of the full motorcycle test.
In the case of CBT training, the pupil should feel sufficiently competent to conduct the fifth element in the prevailing weather conditions at that time. In all other cases the
pupil should also feel competent to conduct further training, including the practicing of any maneuvers required by the full motorcycle test,in the prevailing weather
conditions at that time. In all cases, including but not limited to CBT training, the pupil should consider that the motorcycle/scooter to be used for training is suitable for them
to use for the purposes of the fifth element of CBT training and, in other cases, continued training for the full motorcycle test.
The pupil accepts that although 1 Stop Instruction have replicated the Module 1 training circuit from the Driving Standards Agency (DSA) as much as possible, some of these measurements may differ from those used at the DSA’s Multi Purpose Test Centre (MPTC).
The pupil confirms the wish to carry out any scooter or motorcycle training, either for CBT training or for that of the practical motorcycle test at his/her own risk, and accepts
that such training involves a degree of risk of physical injury to themselves.As such, the pupil agrees not to hold 1 Stop Instruction or any 1 Stop Instruction instructors liable for any injury sustained to him/her whilst carrying out any such training.
The pupil has been made aware that he/she may elect to cease training at any time by notifying the training instructor. In the event of a pupil opting to cease training the pupil
should note that no fees will be refunded to him/her by 1 Stop Instruction.
1 Stop Instruction, or any 1 Stop Instruction instructor, cannot be liable for any items belonging to the pupil whilst he/she is undergoing any training provided by 1 Stop Instruction.
The pupil has also received, read and accepted the terms and conditions of any training provided to the pupil by 1 Stop Instruction, including this liability disclaimer, and especially any reference to any damage deposit or damage waiver premium he/she has remitted to 1 Stop Instruction, prior to the pupil attending any training with 1 Stop Instruction.
THIS DISCLAIMER SHALL REMAIN IN FORCE AND APPLY DURING ANY TRAINING PROVIDED TO THE PUPIL BY 1 STOP INSTRUCTION.
IF ANY PUPIL IS UNHAPPY WITH ANY OF THE ABOVE, HE/SHE SHOULD NOTIFY THE TRAINING INSTRUCTOR IMMEDIATLEY AND REFRAIN FROM
ANY FURTHER TRAINING.IN THIS EVENT NO FEES WILL BE REFUNDED TO THE PUPIL BY 1 STOP INSTRUCTION.
Kneedown & Wheelie School
9 - General
The Pupil accepts that riding a motorcycle and participating in the training, on whatever racing circuit, track, road, or other surface or terrain and whether on public or private highways and regardless of the circumstances or conditions, is inherently dangerous and that it is consequently very difficult for 1 Stop Instruction to insure against risk of injury or other damage. The Pupil therefore and hereby variously agrees, warrants, undertakes and accepts that in participating in the training, whether on a public or private highway or at or on such route or course as may be taken for the purposes of the training, he is
a- voluntarily exposing himself to and will assume all and any risk of damage or loss or personal injury whether to his person, property or otherwise howsoever sustained.
b- solely responsible for the manner in which he rides
c- under a legal obligation at all material times to ride with reasonable care and skill in relation to himself and others
d- responsible for ensuring that he wears appropriate protective clothing that is reasonably fit for its intended purpose
e- under a legal obligation to and will take all steps reasonably required to ensure that nothing he does, or fails to do, will adversely affect the health and safety of 1 Stop Instruction or other participants in the training or any third party and
f- solely responsible for injury, damage or loss that he causes to others.
g-agreeing that the length and format of any training session shall be determined by 1 Stop Instruction and be acceptable by the Pupil. If the Pupil shall elect to cease training after such session has commenced, then he shall be deemed to have cancelled such session of his own accord and, as such, shall forfeit any monies paid to 1 Stop Instruction.
h- agreeing to defend, indemnify and hold 1 Stop Instruction Training Days Limited harmless against any claims, damage costs, expenses and losses arising out of any claim made against it by any persons where such costs and losses are attributable directly or indirectly to the pupils negligence or participation or other involvement in the training or his breach of any terms of these terms and conditions.
10 - Pupil warranty
a- By way of further assurance to 1 Stop Instruction, the Pupil hereby and variously warrants and declares that (a) he is fit & healthy, and that he knows of no reason, medical or otherwise, why he may not or which might otherwise influence the decision of 1 Stop Instruction to allow him to participate in the training (b) his eyesight (with spectacles or lenses which he will wear as necessary) is adequate for the purposes of the training (c) he holds a current full road driving license or a current competition license appropriate for the size & type of vehicle he will use and for the circumstances and venue appointed for the Ride and that (d) he will not participate in the training whilst using, under the influence of or suffering withdrawal from the consequences of alcohol, drugs or medication. The Pupil further accepts that he makes representation as to his ability and qualification to ride the type of motorcycle used in the course of the training, and accepts responsibility for any loss or damage arising from him not being able or qualified to ride such motorcycle.
11 – School Limitations
a- The Pupil understands accepts and agrees that (a) 1 Stop Instruction is a training organisation intended solely for the teaching of knee-down and wheelie techniques and does not represent itself as a riding skills, road skills or road safety training organisation (b) whilst 1 Stop Instruction may, it is not obliged to, give guidance on the standards of riding required and (c) it is not in a position to and will not otherwise enforce or be responsible for and hereby disclaims all and any liability for pupil discipline or pupil safety. The Pupil also accepts that whilst 1 Stop Instruction will use it’s best endeavors to assist the Pupil in achieving a successful kneedown or wheelie, this cannot be guaranteed and is very much dependent upon individual Pupil skills. As such, no claim against 1 Stop Instruction shall be made by the Pupil if he shall not achieve a successful kneedown and/or wheelie.
12 - Notification to Pupil
a- 1 Stop Instruction shall notify the Pupil of the commencement time and training venue of such training session that the parties have agreed to by email. The Pupil should be at the training venue at the advised time and accepts that if he should arrive late the training booked by the Pupil may not be provided and monies paid to 1 Stop Instruction by the Pupil shall be retained by 1 Stop Instruction. In any event, if the Pupil arrives after any safety briefing has begun he shall accept that 1 Stop Instruction shall not provide training to the Pupil and any monies paid to 1 Stop Instruction shall be retained by 1 Stop Instruction and the Pupil shall be liable to remit any balance remaining to 1 Stop Instruction.
13 - Course fees
a- The Pupil shall pay a deposit of £100.00 per training session and in the event of booking a ‘back to back’ session this shall require a deposit of £100.00 for each individual session i.e. £200.00. Any balance of training shall be payable, in cleared funds, prior to any training being provided to the Pupil by 1 Stop Instruction. Any fees paid by credit card, other than using 1 Stop Instructions online booking service, shall incur an additional charge of 5%.
Cancellation/Refunds: If the pupil shall cancel or reschedule any training session with more than 14 days notification to 1 Stop Instruction then an administration fee of £50.00, per training session, shall be retained by 1 Stop Instruction. If the Pupil shall cancel or reschedule any training session with less than 14 days notification to 1 Stop Instruction then Pupil shall forfeit any deposit, per training session, paid to 1 Stop Instruction.
14 - Licence Requirements
a- The Pupil must bring to each training session either an old style driving license with current valid passport, or a new type photo card style license and counterpart. If the photo card has an expired date, it must also be accompanied by a current valid passport for photographic proof. The Pupil shall not be accepted for training if he shall be banned or disqualified at the date of any training session booked. Whichever license is submitted to 1 Stop Instruction for inspection and approval, it must have a current FULL motorcycle entitlement and no type of ‘restricted’ entitlement shall be accepted. Only original documentation shall be acceptable and at no stage shall any photocopy, scan copy or other media be acceptable. A foreign license showing full unrestricted motorcycle entitlement may be accepted, at the sole discretion of 1 Stop, but this booking will strictly be subject to the other terms and conditions.
15 - Damage liability
a- The Pupil shall accept that he shall be liable for any damage to any bike, or other equipment belonging to 1 Stop Instruction, whilst in his care, charge and control. This liability shall be limited to a sum of £500.00 per training session. The Pupil may elect to remit to 1 Stop Instruction a ‘damage waiver’ premium of £25.00 per session which shall be non refundable but any liability by the Pupil’s financial liabilities shall then be limited to this damage waiver premium.
16 – Minimum Height/Protective Clothing
a- The Pupil shall be a minimum height of five foot four inches (1.524 m), barefoot, at the date of training and 1 Stop Instruction shall reserve the right to validate such height. The Pupil shall also be clothed in approved full motorcycle protection clothing including, as a minimum, a protective jacket, protective trousers, boots and gloves, and a full face or flip front type safety helmet (Open face helmets are not allowed). No equipment shall be supplied by 1 Stop Instruction (unless agreed in writing at least 10 days before the pupil's course) and 1 Stop Instruction further reserve the right to determine whether the clothing worn by the Pupil shall be ‘approved’ and any decision made by 1 Stop Instruction shall be final. Furthermore, in the case of KNEEDOWN SCHOOL, the Pupil should ensure that his trousers are fitted with nylon ‘knee sliders’ and, at no stage, shall any ‘knee sliders’ being any other material, in full or part, than nylon be accepted for training. 1 Stop Instruction shall make available, at a cost provided on demand, ‘knee sliders’ on the day of training but it is the Pupils responsibility to affix these, or any other accepted ‘knee sliders’, to his trousers in a manner acceptable to 1 Stop Instruction.
17 – 1 Stop Instruction liability
a- Both 1 Stop Instruction and the Pupil agree that nothing in this Agreement shall exclude or in any way limit 1 Stop Instruction’s liability for fraud, or for death or personal injury caused by its negligence, or any other liability to the extent such liability may not be excluded or limited as a matter of law but further agree that 1 Stop Instruction may and hereby a) excludes its liability to the Pupil for any loss of opportunity, employment contracts, business, salary or other remuneration and profits and for any special indirect or consequential loss or damage whether in contract, warranty, civil wrong (including negligence and breach of statutory duty), or howsoever otherwise, arising out of the performance or breach of this Agreement and b) limits its liability to the Pupil, in respect of all and any other claims to (i) a sum equal to the loss directly and naturally arising from 1 Stop Instruction breach of the express terms of this Agreement and (ii) not exceeding the amount of the sums paid and received by 1 Stop Instruction from the Pupil under the terms of this Agreement; and in any event strictly provided that and in respect of (iii) such claims as are notified to 1 Stop Instruction, in writing, within 28 days of the Pupil first becoming, or when he ought reasonably to have become, aware of them.
18 – Pupil Negligence
a- The Pupil further agrees to defend, indemnify, and hold 1 Stop Instruction harmless against any claims, damages costs, expenses & losses arising out of any claim made against them by any persons where such costs & losses are attributable directly or indirectly to the Pupil’s negligence or participation or other involvement in the training or his breach of any of the terms of this Agreement.
19 – Withdrawal of Service
a- 1 Stop Instruction reserve the right to withdraw its services, without refund or any other right to claim for compensation, loss or damage or otherwise whatsoever, and will be under no further obligation to provide the training or other any service or facility if the pupil is judged by 1 Stop Instruction as acting irresponsibly, unreasonably by or in a manner likely to endanger or cause loss or damage to the Pupil, 1 Stop Instruction or others.
20 – Pupils Obligations
a- If the Pupil fails in his obligations in any of these terms and conditions, 1 Stop Instruction may elect to cease the provision of training to the Pupil immediately and any monies paid to 1 Stop Instruction shall be retained by 1 Stop Instruction. Any failure by 1 Stop Instruction in meetings it’s obligations under these terms and conditions shall result in any financial compensation paid to the Pupil being limited to such amount paid to 1 Stop Instruction by the Pupil for training.
21- Damages relating to vehicles & personal possessions
a- 1 Stop Instruction does not accept liability for loss of or damage to personal items, clothing, motorcycles, vehicles or any other item belonging to the Pupil.
Motorcycle (bike) hire:
b- The Pupil agrees and accepts that: the motorcycle provided is provided to him for the sole purpose of non-competitive use during the training; that if the motorcycle is rendered or appears to 1 Stop Instruction to be unusable or unsafe due to damage whilst in his custody or possession or otherwise as a consequence of his negligence, misuse or neglect the Pupil will (a) forfeit all and any entitlement to participation in any remaining period of the training and any right to a refund, (b) that a replacement motorcycle will not be provided, and that (c) accident repairs cannot be undertaken on location.
c- The Pupil agrees and accepts that: in the event of a motorcycle breakdown caused through no fault of his own, his sole and exclusive remedy against 1 Stop Instruction shall be limited to (and at the sole option or discretion of 1 Stop Instruction) either a refund, determined by reference to the period remaining at the time of the breakdown calculated on a pro-rata basis, or repair or the use of a replacement motorcycle, but that any costs for travel, accommodation and subsistence etc. will not be refunded or otherwise payable to him under any circumstances.
22 - Accommodation
a- 1 Stop Instruction are happy to provide details of local accommodation services, at pupils request. However, 1 Stop Instruction does not directly provide these services, and consequently 1 Stop Instruction is unable to accept and hereby disclaims all and any responsibility for the provision of the same. If a training session is cancelled or rescheduled by 1 Stop Instruction, then the Pupil shall keep 1 Stop Instruction indemnified against any costs associated with such accommodation, or other such costs in respect of travel arrangements or specialized equipment purchase suffered by the Pupil for such training session.
23 - Weather
a- Due to the possibility of adverse weather, 1 Stop Instruction will check the forecast the day before the course and, if neded, contact the Pupil to rearrange the course for another day. It is the Pupil's responsibility to provide current and valid contact information, and 1 Stop Instruction cannot be held liable for any loss or damage sufferd by the Pupil in the event of either the course being rearranged or 1 Stop Instruction being unable to contact the Pupil.
b
- In the event of adverse weather occurring during any training session, 1 Stop Instruction reserve the right to cease training immediately and, if possible, continue the session when and if such adverse weather ceases. The Pupil agrees not to hold 1 Stop Instruction liable for any withdrawal of training session time, and the consequences of such withdrawal, in such event.
24 – Details Subject To Change
a- If circumstances beyond the control of 1 Stop Instruction force 1 Stop Instruction to do so, 1 Stop Instruction reserves the right to, without prior notice, cancel, postpone, reschedule, or make any changes deemed necessary to facilitate the training and/or any other service obtained by 1 Stop Instruction at the request of the Pupil or customer. The Pupil shall keep indemnified 1 Stop Instruction against any losses incurred by the Pupil in such event (s).
b- 1 Stop Instruction reserve the right to cancel any kneedown or wheelie training course which has than less than 4 confirmed attendees. Any attending Pupil shall keep indemnified 1 Stop Instruction against any losses incurred by the Pupil in such event (s).
25 – Training & Travel Insurance
a- If you are taking part in a training event, suitable medical/repatriation insurance is recommended. Note that a European Heath Insurance Card (which has now replaced the old E111), and most standard travel insurance policies do not cover dangerous pastimes such as trackdays, wheelie or kneedown sessions. 1 Stop Instruction do not recommend or warrant any insurance service for the Pupil and, as such, 1 Stop Instruction shall not be liable for any arrangement made, or lack of such arrangement made, by the Pupil.
Driving Instruction / Cars
26 - Payments
a- All payments made by pupils should be in cash, cheque or credit card. All payments must be cleared before the first lesson. Any credit card payments made are subject to an additional charge of 5%. Any returned cheques are subject to an administration fee of £30.00 per return.
b- Individual or blocks of ten lessons are payable for in FULL, in cleared funds, on or before the first lesson. The ten lesson discount can only be applied once per pupil. Please refer to our latest fee scale.
c- Any payments made to 1 Stop Instruction are non refundable except at the absolute discretion of 1 Stop Instruction.
d- Receipt of your deposit/payment is your full acceptance of our terms and conditions.
27 - Refunds
a- Lesson and Course fees are non-refundable. (Refunds will only be issued in exceptional circumstances i.e. if the instructor is unable to provide the service originally booked by the pupil). Deposits are non-refundable.
b- Lesson/course fees may at the discretion of the school be transferred to another 1Stop Instruction instructor.
c- Your Progress/appointment card acts as your receipt and must be brought to every lesson.
d- All lessons must be completed within 3 months of booking (two months if less than ten hours).
28 - Tests
a- Tests, although paid for by candidate, are not guaranteed at the end of hours booked, if the standard of driving, REQUIRED BY THE INSTRUCTOR, for the practical test has not been reached. Extra hours will need to be booked and paid for before candidate is taken for test which will be always at the instructors discretion.
b- Post test courses are to be taken in weekdays between the hours of 9am and 5pm unless special arrangements were made at time of booking. In exceptional circumstances lessons may be able to be arranged for evenings/weekends and these may be subject to additional charge, which will be confirmed by 1Stop Instruction to the pupil.
All post test courses not paid for in full by the due date will be considered as cancelled by applicant and any deposit paid will be forfeited.
c- In the event of mechanical failure, 1stop Instruction liability will be limited to offering replacement lessons for any lessons affected. In the event of the DSA canceling a test, for any reason whatsoever, the pupil is responsible for claiming any compensation payment, which may be due, from the DSA. I Stop Instruction shall remain entitled to retain any monies paid for tuition and/or bike hire in respect of any such cancelled test appointment. 1 Stop Instruction cannot be compelled to provide any training and/ or bike hire for any rescheduled test appointment made by the DSA or the pupil and, in the event of 1 Stop Instruction agreeing to provide such service fees shall be payable by the pupil as agreed with 1 Stop Instruction.
29 - General
a- All instructors work under a franchise contract with 1Stop Instruction. They are responsible to 1Stop Instruction for your tuition, conduct and the condition of their car. 1 Stop Instruction act as agents for it’s franchised instructors and is not responsible for money paid to such instructor or booking dates and times.
b- Every endeavor will be made to make available the same instructor and car for driving lessons and driving test, but the school retains the right to change either if the situation so warrants. In certain circumstances the school/instructor has the right to terminate lessons or test should they feel it necessary.
c- All changes to courses once booked may incur an administration fee of £20.00 and will only be accepted at the discretion of 1stop Instruction. Changes to Test dates are dependant on availability of both test date and instructor, and in most cases must be received and acknowledged before the start date of the course. All changes must be
requested in writing and signed by the person the course has been booked for. Courses and or deposits are not transferable.
30 - Complaints
a- Complaints must be made in the first instance to the instructor concerned. If you are not able to resolve the matter with the instructor, you may telephone the office. As a final step, complaints can be put in writing to 1 Stop Instruction, 18 Regent Gardens, Ilford, Essex IG3 8UL. Complaints in writing will only be considered if received by the school within 21 days of the incident.
31 - Cancellations
a- If you wish to cancel or re-arrange a lesson a minimum 48 hours prior notice must be given. Cancellations must be made directly between you and your instructor. If you do not give at least 48 hours notice of cancellation, your instructor will be entitled to charge you for the lesson(s) cancelled.
